More or less the rules are:

If it's "Region free" (It's from another country, but claims to work on all DVD players), it's pirated.

If it's out long before the offical DVD date, it's pirated.

If it's not a DVD, but a "VCD," a movie on a CD that plays in a DVD player, it's possibly pirated, but not always.

Many Asian countries has a long history with pirating. If fact, they even confiscate product at customs sometimes! I ordered a VCD of Toy Story 2 from a Legit company, and they didn't like it. Thankfully, the company was on the up and up, so they sent it again.

Pirated means it is an illegal and unofficial copy usually made with the intent to sell or to avoid paying the producers, while still enjoying the item. It applies most directly to software, music and movies (analouge, digital stuff).

If you bought some software and copied it and sold the copy, you would be pirating.
